1. Introduction and Acceptance

These Terms and Conditions terms govern all purchases made through dzogchen.org.au website, operated by Namgyalgar, the Australian seat of the International Dzogchen Community. Our ABN is 47 640 353 631 and our registered address is 206 Glasshouse-Woodford road, Glasshouse Mountains, Queensland, Australia.

By placing an order, registering for an event or course, or downloading any digital content through this Website, you confirm that:

  • You are at least 18 years of age, or have obtained parental or guardian consent;
  • You have read and agree to be bound by these Terms in full.

If you do not agree with any part of these Terms, please do not proceed with a purchase.

We reserve the right to amend these Terms at any time. Updates are effective upon publication on the Website. Continued use of the Website or products constitutes acceptance of the revised Terms.

2. Products and Services

Namgyalgar offers the following categories of products and services through this Website:

2.1 Online Courses

Digital learning courses hosted on this Website, including teachings within Buddhist and Dzogchen teachings. Courses may be self-paced or scheduled, and may include video, audio, and written materials. Access terms specific to each course (including duration of access) are stated on the course product page.

2.2 Events

Retreats, webinars, seminars, and community gatherings, offered both in-person and online. Events are sold as registrations granting attendance rights. Specific event terms — including dates, venue, schedule, and prerequisites — are described on each event listing.

2.3 Digital Art — Images and Audio

Downloadable digital files including photographs, illustrations, thangka reproductions, and recordings of music, chanting, or other audio works. These are personal-use digital downloads and are subject to the intellectual property provisions in Section 7.

2.4 Books and Printed Materials

Physical books, booklets, and printed publications shipped to your nominated delivery address. Product descriptions, imagery, and specifications are provided in good faith; minor variations may occur between imagery and physical items.

2.5 Games

Physical or digital games published by or in association with Namgyalgar, including the Dranzhin card game. Physical games are shipped; digital game files are delivered electronically. Game content is subject to intellectual property protections in Section 7.

3. Orders and Payment

3.1 Placing an Order

Orders are placed via WooCommerce on this Website. Completing checkout constitutes an offer to purchase. We reserve the right to refuse or cancel any order — for example, where a pricing error has occurred, where stock is unavailable, or where we reasonably suspect fraudulent activity. You will be notified promptly and any payment received will be refunded in full.

An order confirmation email is an acknowledgement of receipt, not formal acceptance. Acceptance occurs when physical goods are dispatched, digital content is delivered, or event registration is confirmed.

3.2 Pricing and GST

All prices are displayed in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable under Australian law. Shipping costs for physical goods are calculated at checkout. Prices may change at any time without notice; however, confirmed orders will be honoured at the price displayed at time of purchase.

3.3 Payment Methods

Payment is processed through the secure methods available at checkout. We do not store your financial information. Full payment is required before any order is processed, course access is granted, event registration confirmed, or digital content delivered.

4. Delivery

4.1 Physical Products (Books and Games)

We aim to dispatch physical orders within 5 business days of payment confirmation. Delivery timeframes are estimates and depend on the carrier and destination. Risk of loss or damage passes to you upon delivery to the carrier. We recommend verifying your delivery address before completing checkout.

4.2 International Shipping

International customers are responsible for any customs duties, taxes, or import charges applicable in their country. We are not liable for delays caused by customs processing or international postal services.

4.3 Digital Products (Courses, Art, Audio, Digital Games)

Digital products are made available for download or streaming access upon payment confirmation, via a link sent to the email address provided at checkout. Courses and digital content may be hosted on this Website and accessed via your account. If you experience difficulty accessing purchased content, contact us.

4.4 Events

Upon registration and payment, you will receive confirmation details by email, including joining instructions for online events or venue details for in-person events. It is your responsibility to ensure you are able to attend at the scheduled time.

5. Cancellations, Returns, and Refunds

Your statutory rights under the Australian Consumer Law (ACL) apply at all times and cannot be excluded by these Terms.

5.1 Physical Products

Subject to your ACL rights, we do not accept returns for change of mind. If a physical product arrives damaged, faulty, or materially different from its description, contact us within 14 days of receipt with your order number, a description of the issue, and supporting photographs. We will offer a remedy in accordance with ACL requirements (repair, replacement, or refund as appropriate).

5.2 Digital Downloads and Online Courses

Due to the nature of digital goods, all sales of digital downloads and online course access are final once content has been accessed or downloaded, except where required by the ACL. If you experience a technical fault with digital content, contact us and we will endeavour to resolve the issue or provide a remedy.

5.3 Events

Cancellations by the participant are subject to the following:

  • More than 30 days before the event: full refund, minus any non-recoverable third-party costs (e.g. payment processing fees).
  • Between 14 and 30 days before the event: 50% refund.
  • Less than 14 days before the event: no refund unless the event is cancelled or significantly changed by us.
  • Transfers of registration to another person may be arranged subject to our agreement — contact us as early as possible.

If we cancel or significantly alter an event (date, format, or location), we will offer you a full refund or the option to transfer your registration to a rescheduled or equivalent event.

5.4 How to Request a Remedy

To request a return, refund, or remedy, contact us at [contact email] with your order number and full details of the issue. We aim to respond within 5 business days.

6. Courses and Events — Specific Terms

6.1 Access and Eligibility

Some courses and events within the Namgyalgar programme may have prerequisites or require membership of the International Dzogchen Community. These requirements are stated on the relevant product page. We reserve the right to decline enrolment where eligibility requirements are not met.

6.2 Course Access Duration

Lifetime or extended access to online courses is offered on the basis of our ability to maintain the hosting infrastructure. While we intend to provide long-term access, we cannot guarantee indefinite availability. Where access is time-limited, this will be clearly stated on the course page.

6.3 Recording of Online Events

Some online events may be recorded. Where this is the case, it will be communicated to participants in advance. Recordings are the property of Namgyalgar and may be made available to registered participants or the wider community at our discretion.

6.4 Code of Conduct

All participants in events and online courses are expected to engage respectfully and in alignment with the values of the Dzogchen community. We reserve the right to remove participants who behave in a manner that is harmful, disruptive, or contrary to community values, without refund.

7. Intellectual Property

All content associated with Namgyalgar and available through this Website — including teachings, course materials, images, audio recordings, books, games, artwork, and logos — is protected by Australian and international copyright law and remains the property of Namgyalgar or its respective rights holders.

Purchase of any product grants you a personal, non-transferable, non-commercial licence to use that content for your own private, spiritual, and educational purposes only. You may not:

  • Reproduce, copy, or duplicate content for distribution or public display;
  • Share login credentials or course access with others;
  • Sell, sublicense, or commercially exploit any purchased content;
  • Modify or create derivative works without prior written permission.

The teachings of Chogyal Namkhai Norbu and Namkhai Yeshi are offered in a spirit of non-commercial integrity. Products rooted in these teachings — including course content and the Dranzhin card game — may not be used for commercial purposes without our express written consent.

8. Privacy

We collect personal information (including your name, email address, and delivery address) solely to process and fulfil your order, manage your course or event registration, and communicate with you about your purchase.

We do not sell, rent, or share your personal information with third parties except where necessary to fulfil your order (for example, shipping carriers) or as required by law. Our practices comply with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles.

9. Disclaimer and Limitation of Liability

This Website and its content are provided in good faith. We make no warranties, express or implied, as to the completeness, accuracy, or fitness for purpose of any content, product, or service offered, except where required by the ACL.

To the maximum extent permitted by law, Namgyalgar excludes all liability for indirect, incidental, consequential, or special loss or damage arising from your use of this Website or any product purchased through it, including loss of data, profits, or opportunity.

Nothing in these Terms limits or excludes any consumer guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law. Where liability cannot be excluded, it is limited to the lesser of: (a) the replacement or resupply of the relevant product or service; or (b) the amount paid by you for that product or service.

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the Website will be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia.
